Information on Marina Operating Permit Program

On 11/4/2009 House Bill 5055 was enacted as 2009 P.A. 139. These ammendmenrts to part 301, Inland Lakes and Streams, of the NREPA took immediate effect. The requirement for a Marina Operating Permit (MOP) was recinded. Construction, expansion, or reconfiguring a marina requires a construction permit. These ammendments also added additional construction permit review criteria which were previously in the Part 301 administrative rules for MOP. Existing marinas whose current mooring configurations were not authorized by a construction permit issued by the DEQ must apply for a construction permit when they expand or reconfigure their marina or by January 1, 2012, whichever comes first.
